Terms & Conditions of Sale

Last updated: September 2026. These terms and conditions of sale apply to any order placed on the Guermello website and intended for delivery in Morocco.

1. Scope

These terms and conditions of sale ("Terms") govern every order placed on the Guermello website and intended for delivery in Morocco. Placing an order implies full and unreserved acceptance of these Terms.

They apply to the exclusion of any other document (brochures, catalogues, advertising). Guermello may update these Terms at any time; the version applicable to an order is the one in force on the day the order is placed.

2. Products

The products offered are artisan-roasted nuts, dried fruits, chocolate-coated treats, gourmet gift boxes and related gourmet products, intended for human consumption and produced in compliance with current Moroccan food-safety regulations (ONSSA).

Product photographs are indicative. The net weight, composition and allergens shown for each product are the reference information.

3. Prices

Prices are shown in Moroccan Dirhams (MAD), tax included (TTC), at the time of the order. Guermello reserves the right to change its prices at any time; the products are invoiced at the prices in force when the order is confirmed.

Delivery costs are added to the price of the products and are clearly indicated before the order is confirmed.

4. Order and confirmation

The order is validated by the Customer after verifying its content (products, quantities, delivery address, total amount). The sale is definitively concluded only after Guermello confirms the order by email.

Guermello reserves the right to refuse or cancel any abnormal or fraudulent order, or any order where a product is unavailable, with a refund or cancellation free of charge to the Customer.

5. Payment

Payment is made, at the Customer’s choice, using the methods offered on the website: cash on delivery, or any other online payment method offered at the time of the order (bank card / CMI).

For cash on delivery, the amount due is paid to the carrier or the delivery driver when the order is handed over. Failure to pay results in the return of the goods.

6. Delivery

Orders are delivered throughout Morocco via the Turboliv service. Stated times are 1 to 2 working days from order confirmation, subject to product availability and served areas.

Applicable delivery charges: 20 MAD in Casablanca, 30 MAD in its suburbs, 35 to 45 MAD depending on the city. Delivery is free for orders of 600 MAD and over.

The Customer must check the condition of the order on receipt and report any anomaly (open parcel, missing or damaged product) to the carrier, then to Guermello as soon as possible.

7. Withdrawal, exchanges and returns

In accordance with Moroccan Law No. 31-08 on consumer protection, the right of withdrawal applicable to distance contracts does not apply to perishable foodstuffs such as roasted nuts, whose quality cannot be preserved after opening, nor to personalised products.

In the event of a non-conforming product (wrong reference, quantity, defective product on receipt), Guermello undertakes, after examination, to replace the product or refund the Customer at no extra cost.

8. Legal warranty and liability

Products benefit from the legal warranty of conformity provided for by Law No. 31-08. Guermello undertakes to deliver products compliant with current regulations on food quality and safety (ONSSA approval).

Guermello’s liability cannot be engaged in the event of abnormal use of the products, failure to follow the storage advice provided, or unforeseeable and insurmountable events (force majeure).

9. Personal data

The information collected when an order is placed (name, contact details, delivery address) is necessary for processing and delivering the order, and for sending any commercial messages when the Customer has consented.

It is processed in accordance with Moroccan Law No. 09-08 on the protection of individuals regarding the processing of personal data (CNDP) and is never passed on to third parties for commercial purposes.

10. Force majeure

Guermello cannot be held liable for failure to perform its obligations if this failure is due to a force-majeure event: carrier strikes, natural disaster, pandemic, communication-network failure or any other unforeseeable and insurmountable circumstance.

11. Intellectual property

All elements of the website (texts, visuals, logo, photographs) are protected by intellectual-property law. Any reproduction or use without the prior written authorisation of Guermello is prohibited.

12. Applicable law and disputes

These Terms are governed by Moroccan law. In the absence of an amicable resolution, any dispute relating to their performance will be brought before the competent Moroccan courts, in particular the Casablanca commercial court, subject to the consumer-protection rules provided for by Law No. 31-08.
